Real Estate Regulatory Authority
The Real Estate Regulatory Authority (RERA) is a statutory body established under the Real Estate (Regulation and Development) Act, 2016, to regulate the Indian real estate sector. It functions as a central oversight mechanism designed to enhance transparency, ensure financial accountability, and protect the interests of homebuyers and investors through standardized project disclosures.
The establishment of RERA marked a significant shift toward professionalizing the Indian property market by mandating that developers register all commercial and residential projects exceeding 500 square meters or eight apartments. This regulatory framework addresses historical issues such as project delays, fund diversion, and misleading advertising. By requiring developers to maintain a separate escrow account for 70 percent of project funds, the authority ensures that capital is strictly utilized for construction, thereby mitigating the systemic risk of insolvency and project abandonment for stakeholders.
In practice, RERA mandates that developers provide comprehensive project details, including site plans, approvals, and completion timelines, on a public digital portal. Buyers should verify a project’s unique registration number on the state-specific RERA website before committing to any transaction. Furthermore, the authority provides a formal grievance redressal mechanism, allowing buyers to file complaints against developers for non-compliance or contractual breaches. Practitioners must monitor these state portals to ensure all documentation remains current and compliant with local regulatory amendments.
